Terms of Use

These terms of use (the "Terms") set out the terms and conditions that apply to browsing the Site.

1. Acceptance

These Terms of Use for the leasey.ca Site (the "Terms") form a legal agreement between you and Leasey Inc. ("Leasey"). You must accept these Terms before you can use the Site. You may accept these Terms by browsing the Site, or by checking a box indicating that you accept the Terms, where such a box is made available to you. If you disagree with these Terms, do not browse the Site.

2. Access

To use the Site and the services, you must be of legal age. You must also not be located in a country where, for any reason whatsoever, the publication of or access to the Site and its Services is prohibited. We make no representation that the use of the Site and its content is lawful or permitted under the laws of every country. You bear all risks associated with using the Site. It is your sole responsibility to act in compliance with the laws and/or regulations in force in your country of residence.

3. Updates

We may update or modify these Terms from time to time and we recommend that you review them regularly. You can view the most recent version of the Terms at any time on the Site. When we make a change to the Terms, the new version is published on our Site at the address indicated. You understand and agree that your continued use of the Site after the Terms are modified constitutes your acceptance of the modified Terms.

4. Other terms

These Terms take precedence over the provisions of any other legal notices. In the event of any inconsistency between the provisions of these Terms and those of any other legal notices, the provisions of these Terms shall prevail. Other conditions may apply to the services provided by Leasey and may be the subject of a specific contract, without thereby invalidating these Terms.

5. Site content

The Site, including all of its content, is the property of Leasey and of third parties and is protected by Canadian and international laws governing copyright, trademarks and other matters. Your use of the Site grants you no ownership or other rights in the Site or its content.

For strictly private, non-commercial use, you may retrieve and display the content of the Site on a computer screen, print individual pages on paper and keep an electronic version of those pages on a disk (excluding any server or any network-connected data storage device), provided that you do not modify any of the Site's pages or other parts of its content and that you neither remove nor alter any copyright notice. You will carry out any download or printing taking into account the copyright notices appearing on the originals and you will ensure that they appear intact on the copy you make. You will also remain bound by those wordings and notices.

6. Third-party links and material

Certain components or features of the Site and its content may contain third-party material or hypertext links to other websites, resources, or content. Because Leasey does not necessarily control such third-party sites or material, you acknowledge and agree that Leasey is not responsible for the availability of such sites or resources, does not endorse or warrant the accuracy of such sites or resources and is in no way responsible for the content, advertising, products, or material available on such sites or resources. You also acknowledge and agree that Leasey is in no way responsible for any damage you incur or claim to have incurred, directly or indirectly, as a result of your use of or reliance on the content, advertising, products, or material available on such sites or resources.

7. No warranty

Some jurisdictions do not allow the exclusion of certain warranties; as such, to the extent that those exclusions are specifically prohibited by applicable law, some of the exclusions set out below may not apply to you.

You expressly acknowledge and agree that your use of the Site is at your sole risk and that the Service is provided "as is" and "as available." Leasey and its affiliates, subsidiaries, officers, directors, employees, agents, partners and licensors expressly disclaim all warranties, express or implied, including without limitation the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

You access any material downloaded or otherwise obtained through the use of the Site at your own discretion and at your own risk and you are solely responsible for any damage to your device or any loss of data resulting from the download of such material.

8. Limitation of liability

Some jurisdictions do not allow the exclusion or limitation of liability for incidental or indirect damages; as such, to the extent that those exclusions or limitations are specifically prohibited by applicable law, some of the exclusions or limitations set out below may not apply to you.

You expressly acknowledge and agree that Leasey and its affiliates, subsidiaries, officers, directors, employees, agents, partners and licensors shall not be liable to you for any direct, indirect, incidental, special, intangible, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, the cost of procuring substitute goods or services, or any other intangible loss (even if Leasey is aware of the possibility of such damages), arising out of:

  • (i) the use of, or inability to use, the Site;
  • (ii) any modification made to the Site or any temporary or permanent discontinuation of the Service or any part of it;
  • (iii) the unauthorized access to, or alteration of, your transmissions or data;
  • (iv) the deletion, corruption, or failure to store, send, or receive your transmissions or data on or through the Site;
  • (v) the statements or conduct of any third party on the Site; and
  • (vi) any other matter relating to the Site.

In particular, but without limiting the foregoing, any liability relating to claims connected with the need to update the services or information for the purpose of complying with legislative changes, with the misuse of such information or services, or with their use for unlawful purposes is excluded.

9. Force majeure

Leasey shall not be deemed to be in breach of its contractual obligations where such breaches result from the occurrence of an event of force majeure.

Force majeure means any event beyond Leasey's control, unforeseeable and unstoppable, of any nature whatsoever: natural disasters, severe weather, fires, epidemics, floods, avalanches, landslides or ground subsidence, strikes, sabotage, embargo, interruptions or delays in transportation or means of communication, equipment failures, acts or regulations issued by public, civil, or military authorities (including delays in obtaining authorizations or permits of any kind), war and the like, which have the effect of rendering these Terms temporarily or permanently impossible to perform.

10. Notices

Leasey may send you notices regarding the Service, including changes to these Terms, by email to the address you provided us, by postal mail, or by message on our Site or on the Service. You also agree to receive any information, publication, or advertising from Leasey by email.

11. Protection of personal information

Leasey takes care to collect only the personal data necessary for the operation of the Site and to take appropriate security and confidentiality measures. Please review our privacy policy, available on the Site.

By accepting these Terms and each time you use the Site, you consent to our privacy policy.

12. Governing law

These Terms, as well as the use of the Site, are governed exclusively by the laws of the Province of Quebec and the applicable federal laws of Canada, to the exclusion of any other rule of law.

You agree to irrevocably submit any dispute between Leasey and you, or any other person, relating to the Site, this agreement, or any related matter, to the courts of the Province of Quebec, judicial district of Montreal.

13. General

Except for specific contracts entered into in connection with the Service, these Terms constitute the entire agreement between you and Leasey, govern your use of the Site and entirely supersede any prior agreement between you and Leasey in connection with the Site. You may also be subject to additional general terms applicable when using the Site, third-party content, or affiliated third-party software.

If any part of these Terms is held to be invalid or unenforceable, it shall be interpreted in accordance with applicable law so as to reflect, as far as possible, the original intentions of the parties and the remaining provisions shall remain in full force and effect.

The parties acknowledge that they have agreed that this agreement, as well as all documents, notices and legal proceedings that may be executed, given, or brought further to or in connection with this agreement, directly or indirectly, be drafted in French. In the event of any conflict between foreign-language versions of the Terms, the French version shall prevail.

Leasey's failure to exercise or enforce any right or provision of the Terms does not constitute a waiver of that right or provision. You agree that, except as expressly provided otherwise in these Terms, this agreement confers no indemnity on any third party.

These terms of use are complementary and cannot replace the terms of service set out in the contract.
